ORDINANCE or THE OGLÄ%Ä SIOUX TRIBAL COUNCIL

OF THE OGLALA SIOUX TRIBE

(An Unincorporated tribe)

        ORDINANCE OF THE OGLALA SIOUX TRIBAL COUNCIL OF   OGLALA SIOUX

       AUTHORIZING AND DIRECTING       OSC PARKS AND RECREATION

CONJUNCTION WITH THE ost LAND DEPARTMENT TC ROUNDü?t HOLD AND sati NECESSARY ALL STRAY HORSES UPON THE PI-NE RIDGE INDIAN RESERVATION.

WHEREAS, the Oglala Sioux Tribe is a sovereign tribal nation that hag entered into treaties ag the -fi euueme law of the land" with the United States government pursuant to t.he U.S. Constitution Article VI, and ig a signatory to the Treaty of Fort Laramie of 1851, I Stat. 749 (Sept .17 , 1851) / and the Treaty of Port Laramie of 1368, 15 Stat. 635 (Apr. 29, 1868) and continues the nation to nation relationship with the federal government, and

WHEREAS, the Oglala Sioux Tribe organized under Section 16 Of the Indian Reorganization Act of 1934 (25 U.S. C. S 5123), by adopting federally approved Constitution and By—Laws, and under Article Ill o: the Tribal Constitution, the Oglala Sioux tribal Council is the governing body of the Tribe, and

WHEREAS/ Article IVr Sections I (f) r i I (re) , and i (w) empower the Tribal Council to manage the affairs of the Tribe, protect and preserve the of the Tribe, adopt laws governing the conduct of persons on the Pine Ridge Indian Reservation f and adopt laws protecting and promoting the health and general welfare of the Oglala Sioux Tribe and its membership ; and WHEREAS, roaming or stray horses have become an increasing problem upon the Pine Ridge Reservation, and are responsible for numerous vehicle accidentg which result in the loss of property to tribal members and tribal programs, and which in most cases results no avenues for those who suffer losses to recoup the{r losses, and

WHEREAS, it is the responsibility of the Oglala Sioux Tribe to help protect tribal merubers from suffering such losses r and

WHEREAS p the Oglala Sioux feel,$ that a fine schedule should be adopted to deal with Che stray horse problem in which a fine shall be impOged upon owners Of stray höt$es, ancl

WHEREAS, all horse owners will be held responsible for any propetty losses caused by their stray horses, and

WHEREAS, the OST Parke end Recreation Authority and the OST La rid Office shall be responsible for enforcement of this Ordinance and shall be the caretakers of the horses} seized under this Ordinance, Änci ORDINANCE NO. 24'-03

the attached Procedures and Pine/ Penalty schedule is incorporated and made a part of this ordinance; now

 BE IT ORDAINED, that the Oglala Sioux Tribal Council does hereby based upon the recommendation of the Oglala SIOUX Tribe Land Committee adopt this ordinance authorizing and directing OSPRA and OS? Land Office to roundup, hold and sell stray horse upon the Pine Ridge Indian Reservation and the attached Procedures and Fine/ Schedule, and

IT FURTHER ORDAINED, that the OST President or ih his absence the_ •vice—president is authorized to sign this resoluuon.

OSPRA and OST Land Office be notified by any reporting agency or conununity mernber of stray, unsecured horses on tribal or state toadways within the exterior boundaries of the Pine Ridge Indian Reservation.
